These terms and conditions apply to the use of any of the websites owned and operated by Is Your Bag Packed. By accessing this website, you agree to be bound by the terms and conditions set out below. DEFINITIONS
'Is Your Bag Packed' refers to Is Your Bag Packed Limited, whose registered office is at 116 Bunstead Lane, Hursley, Hampshire, SO21 2LQ. Company Registration 5874181.
'website' refers to any of the websites owned and operated by Is Your Bag Packed.
'net order value' is the total value of the order after deduction of any discounts, deals or special offers but before the deduction of any vouchers issued by Is Your Bag Packed. The net order value is used to calculate carriage and delivery charges.
GENERAL CONDITIONS
All orders for goods shall be subject to these terms and conditions. No variation of these terms and conditions shall apply unless agreed in writing by Is Your Bag Packed.
Is Your Bag Packed guarantee that all goods on offer are as described on the website and are fit for their intended purpose. Should any product fail to meet our high standards it will be replaced immediately. This does not affect your statutory rights.
Orders can only be accepted from customers who are 18 years or older. If you are under 18 years of age you are welcome to browse our website but regret that we are unable to accept any order from you.
We strongly recommend that you take the time to read and understand these Terms and Conditions fully as they will be binding upon you and will govern the contract between us once you have placed your order and it has been accepted by us. Upon acceptance we will send you an email confirmation of your order. However, we cannot guarantee receipt by you of such confirmation email and suggest that you contact us if you have not heard from us within 48 hours of placing your order.
PRIVACY & SECURITY
We are committed to protecting the privacy of our customers. It is our intention to operate and only to use the information provided by you in accordance with the provisions of the Data Protection Act 1998.
Personal information (e.g. name, address, telephone number, e-mail address) provided by you will be used solely for the purpose of completing your purchase order as efficiently as possible. This may include (but not be limited to) e-mail or telephone communication to keep you informed of progress or other matters surrounding your order.
We might use these details to contact you from time to time with information about our new products or services. We will never pass your information on to third parties unless authorised by you, or we are required to do so by law. If you do not wish to receive information from Is Your Bag Packed, please contact us.
If you choose to pay us by Credit/Debit Card you will automatically be transferred to the Nochex secure server. They will process your card payment transaction in a highly secure environment using 128 bit SSL Verisign Encryption. Nochex are an accredited payment service provider and at no stage are your card details notified to us. Upon completion of your payment, you automatically return to our website.
PURCHASE & PAYMENT TERMS
A. Pricing
The price of the products will be those quoted on the website, errors & omissions excepted.
Delivery costs are as quoted and are calculated on the total weight of your order. These are payable by you and may be changed by us at our discretion.
All pricing and delivery charges are based on UK, Channel Islands and Isle of Man delivery addresses. Any alternative purchase and despatch requirements will require our individual and specific agreement which cannot be guaranteed. In such circumstances please contact Is Your Bag Packed to agree terms prior to placing your order.
Any special pricing offers made are intended to be independent and must not be used in conjunction with any other offer.
B. Purchases
We take payment at time of order and payment will be debited from your account prior to despatch of your purchase(s).
Payment for goods ordered can be made on-line by any major credit card or debit card. In paying by this method you are confirming that the card being used is yours. In the event of payment being declined by your card issuer, Is Your Bag Packed shall not be responsible for any costs or inconvenience caused by a subsequent delay in despatch.
We offer alternate methods of payment also:
Cheque - please print off your order and send it to us along with a sterling cheque or money order made payable to Is Your Bag Packed Ltd. N.B. Goods will not be despatched until funds have cleared.
Bank Transfer - if you choose this option, the site will show our bank details for transfer. Again, the goods will be despatched upon receipt of funds.
An order is not deemed accepted until we send you our order confirmation e-mail, whether or not this is received by you.
In the unlikely event of our not being able to satisfy your order due to stock unavailability, we will contact you with a view to agreeing an alternative solution.
Delivery
Delivery charges shown in the Checkout page of this website are per order, not per item, provided they relate to one delivery address. Additional delivery addresses require separate orders to be made and charges are based on UK recipients.
For products in stock, we will usually despatch your items within two working days, but during especially busy periods this may not be possible. We would ask you allow up to seven working days for your order to arrive.
We offer a choice of services; 24 hour and 48 hour (following despatch) and the price is dependent upon the weight of your order (this will be calculated as part of the checkout process). Delivery is a maximum of £8.50 to any UK destination on a 24 hour service, regardless of weight. The 48 hour service is a maximum of £7.00.
Orders need to be signed-for on delivery, both with Courier and Royal Mail delivery services. If you are out, a card will be left requesting you contact the Courier's local depot to arrange re-delivery, or your local post office. If they do not hear from you within 5 working days your order may be returned to our office. If the delivery is returned to our offices we reserve the right to charge for re-delivery.
Every effort is made to maintain stock levels to keep up with demand but to avoid disappointment it is advisable for you to allow as much time as possible when considering your purchase. We will communicate with you should any item not be in stock and indicate the best estimate for supply and delivery.
Please feel free to communicate with us at any time to ensure we are aware of your delivery requirements.
Products will be despatched to the delivery address you provide which we will treat as correct.
Once you receive the products, all risks of loss or damage shall pass to you and become your responsibility. Regardless of delivery and the passing of responsibility for loss or damage or any other provisions contained herein, the ownership of the products shall not pass to you unless we have received full payment for all products (including delivery charge) forming the total purchases made.
CANCELLATION, RETURNS & REFUNDS POLICY
Cancellation of Order
Under the Distance Selling Regulations, all UK customers have the right to cancel orders placed through a website within seven working days of their receipt of the goods. UK residents wishing to cancel an order under these Regulations should return the goods to the address below in their original packing and in their original condition and write to us letting us know that they intend to exercise this right.
Is Your Bag Packed will not accept any responsibility for loss or damage to goods returned in this way until they are received at our below address, and we strongly recommend that returns are sent by Recorded Delivery or some other means of tracked delivery system that records both your proof of postage and a signed receipt of delivery. We cannot be responsible, nor can we refund/exchange, in cases of non-receipt by us.
Once we receive the goods in saleable condition, a refund for their cost will be made to the purchasing debit/credit card or, in the case of cheque payment, to the same named person.
Customers are responsible for the cost of returning the goods to Is Your Bag Packed. Please note, we do not refund any carriage charges paid.
After seven days following your receipt of the goods, we will assume completion and acceptance of the items and your automatic right to refund will no longer be available.
If an item received is incorrect, faulty, or damaged we shall of course be happy to provide you with a full refund (including cost of delivery) or offer to replace the item at no cost to you. We will require you to return the original item, and will also therefore refund the return postage cost. Please utilise all the original packaging.

We will always endeavour to respond to any written complaint within 5 working days of receipt. If we need to make further investigation with our suppliers we will keep you informed of our progress at regular intervals.

We shall not be liable for any loss or damage of any kind, including but not limited to any consequential loss and special damages, arising howsoever caused from your access to, use of, or inability to access, this website, including reliance upon the content of this website.
We shall not be liable for errors, inaccuracies or the failure to keep this website and the information held hereon up to date for which we additionally accept no express or implied duty.
Some of the information contained on this website relating to products or services provided is supplied to us by third parties and accordingly no warranty is given as to the accuracy of such information.
All liability is excluded to the fullest extent permitted by law. But nothing contained in these terms and conditions shall exclude or limit our liability for death or personal injury resulting from our negligence, nor affect your rights as a consumer under any Unfair Contract Terms legislation.
